Succession Certificate vs Letter of Administration in Pakistan

A succession certificate and a letter of administration are not two names for the same document. In the current NADRA process, a succession certificate is issued for movable property, while a letter of administration is issued for immovable property. A family dealing with both a bank account and a house may therefore need both. Choosing the wrong application can waste time before the merits of the estate are even considered.

Neither document creates a new inheritance scheme. The heirs and their shares still come from the personal law applicable to the deceased; the grant supplies authority to collect or administer identified assets. For the broader distribution rules, see our inheritance law in Pakistan guide.

1. The Difference in One Minute

Use a succession certificate for movable assets that require proof of authority to collect or deal with them, especially debts and securities specified in the certificate. Typical applications concern bank balances, deposits, shares or securities, although the institution and the legal character of the particular benefit must be checked. Use a letter of administration for immovable property such as land, a house or a commercial unit. If the estate contains both categories, prepare a complete inventory and ask for the appropriate document for each.

Classify the asset, not its paperwork. A title document is movable paper, but the land it proves is immovable. Pension, insurance, provident-fund and nomination arrangements may also follow separate statutes, rules or contracts, so confirm the underlying entitlement before listing them as ordinary estate assets.

2. What a Succession Certificate Does

Part X of the Succession Act 1925 deals with succession certificates for debts and securities. The certificate identifies the covered debt or security and empowers the holder to collect it and, where stated, receive interest or dividends, negotiate it or transfer it. Section 381 protects the debtor or person liable on the security when making a good-faith payment or dealing with the named certificate holder. That practical protection is why a bank or company will normally require formal authority before releasing an asset.

A succession-certificate proceeding is not a final trial of every ownership issue. Section 387 permits the same question of right to be tried later and requires a recipient to account to the person lawfully entitled. The certificate enables collection; it does not let one heir disregard the lawful shares.

3. What a Letter of Administration Does

A letter of administration appoints and authorises an administrator where an estate must be administered and there is no acting executor with probate. Under section 220 of the Succession Act, letters of administration entitle the administrator to the rights belonging to the intestate as effectively as if administration had been granted immediately after death. In the special NADRA succession laws, the label is used for immovable property and the document is issued in favour of the legal heirs with their respective shares.

Administration is a responsibility, not a gift. The administrator deals with property for those lawfully entitled. A letter may be needed for mutation, but it does not complete every land-record, housing-authority or society formality. 4. The Current NADRA Route

Federal and provincial succession laws authorise NADRA to issue these documents through Succession Facilitation Units and designated registration centres. NADRA's current succession service page states that the deceased and legal heirs must be Pakistani citizens and the assets or property must be in Pakistan. One legal heir begins the application after obtaining authority from the others; NADRA presently specifies filing through legal counsel in Sindh and Balochistan.

The official list includes the death certificate, NADRA CNIC cancellation certificate, Family Registration Certificate, heirs' CNIC copies, asset details and an authorisation or affidavit attested by an Oath Commissioner. Asset evidence such as a bank statement, share record, allotment letter, registry or fard may also be needed.

The statutory model includes public notice followed by biometric verification of the applicant and heirs if no objection is received. NADRA currently states a processing period of 14 days after publication. Treat that as the published service period for a straightforward application, not a guaranteed completion date for missing records, an unverified heir, a disputed family tree or an asset whose title is unclear. Fees and operational requirements can change, so check the official page at the time of filing.

5. When the Matter Goes to Court

The administrative route is for cases resolvable through records, notice and biometrics. An heir's objection, disputed marriage or paternity, conflicting identity record, contested will, alleged fraud or disputed title may require adjudication by the competent court or forum.

The exact trigger is province-specific. The Sindh Letters of Administration and Succession Certificates Act 2021, for example, defines “controversy” to include an objection, an unresolved dispute about the identity of legal heirs, a matter requiring adjudication or evidence, and a situation in which at least one legal heir is a minor. Its Succession Facilitation Unit must decline assessment in a controversy so the matter can be filed before the appropriate forum. Other jurisdictions must be checked under their own statute and rules rather than assuming that this definition applies word for word nationwide.

6. Provincial and Territorial Differences

The federal Letters of Administration and Succession Certificates Act 2020 applies within its legal extent, while the provinces have their own succession-facilitation laws or rules. The Khyber Pakhtunkhwa Code, for example, separately lists the Khyber Pakhtunkhwa Letters of Administration and Succession Certificates Act 2021.

Jurisdiction can depend on the deceased's last residence, the asset location and the notified office. Publication, counsel, minors, overseas biometrics and court referral can differ. Identify those facts before preparing the application.

7. Overseas Heirs and Difficult Assets

An overseas heir is not excluded, but identity and authority must still be verified. Some statutes permit biometrics at notified offices abroad; availability should be confirmed for the country concerned. A power of attorney must not be used to omit an heir or bypass required verification.

Difficult assets should be separated rather than forced into one category. A deceased shareholder's shares, money owed to the deceased, a jointly operated account, leased property, a housing-society allotment and land recorded under an incomplete title can each raise different questions. Nominations also require care: naming a recipient may authorise collection under a scheme without necessarily deciding ultimate beneficial ownership. 8. What Happens After Issue

After issue, certified copies go to the bank, company, debtor or institution holding the specified asset. Keep records of every receipt and distribution because the certificate holder remains accountable to the lawful beneficiaries.

For immovable property, the letter of administration is taken into the relevant mutation or transfer process. Heirs may become co-owners in their recorded shares. If they want physical division, sale, relinquishment or transfer to one heir, that is a separate transaction requiring consent or legal proceedings, proper instruments and the applicable taxes and fees.   • Prepare one inventory separating movable property from immovable property and identify the institution or authority controlling each asset.
  • Obtain the death certificate, CNIC cancellation certificate, FRC and CNIC copies for every legal heir.
  • Collect title and value evidence for each asset, including bank or share records and land, registry or allotment documents.
  • Confirm the personal law governing the deceased and calculate the heirs' shares before making distribution promises.
  • Ask whether any heir is a minor, abroad, unverified, omitted from the FRC or likely to object.
  • Check the statute, notified office, counsel requirement and biometric arrangements for the relevant province or territory.
  • Separate disputed heirship, title, wills and nominations for legal review instead of presenting them as routine facts.
  • After issue, complete each bank, company, revenue, authority or society transfer process and keep distribution accounts.

Can one application cover bank accounts and land?

Can an overseas heir complete biometrics abroad?

Some statutory schemes permit verification at notified offices abroad, but availability and the required authority documents must be confirmed with NADRA for the relevant country and jurisdiction. Do not omit an overseas heir because attendance is inconvenient.
